Terms of use

1. Purpose
These terms of use (the “Terms”) govern access to and use of the fathomcharts.com website, the account pages, the REST API and the WebSocket stream (together, the “Service”) published by Adrien Insights (“we”), whose details are given in the legal notice.
The Service computes order flow indicators (footprint, big trades, imbalances, VWAP…) on futures contracts server-side, and delivers them in real time or over history, with the parameters chosen by the user.
Purchases of paid plans are also governed by the terms of sale. In case of conflict, the terms of sale prevail on matters of sale.
The French version of these Terms is the authoritative one; this English version is provided for convenience.
2. Acceptance
By creating an account or using the API, you accept the Terms in their current version. If you act on behalf of a business, you represent that you are authorized to bind it, and “you” then also means that business.
The Service is reserved for adults with legal capacity to enter into contracts.
3. Account
Sign-in is passwordless, through a link sent to your email address. You are responsible for access to that address: anyone who can read it can sign in to your account. You agree to provide an accurate address that belongs to you, and to tell us about any unauthorized use of your account.
An account is personal: one person, or one business for its own use. You do not create several accounts to get around the limits of a plan.
4. API keys
Access to the API and the stream uses keys created from the account pages (at most 10 keys per account). A test key gets the rights of the free Sandbox; a live key gets the rights of the plans of your account.
- A key is secret. It is shown only once, when created; we only keep a fingerprint of it and cannot recover it.
- You keep it server-side: never in a published app, a public repository or a web page. For a browser, use the short-lived stream tokens provided for that purpose.
- Any use made with your keys is attributed to you and counts toward the limits of your account.
- If a key is exposed, replace or revoke it right away from the account pages.
5. Use of the data
The market data used by the Service is provided by Databento, Inc.; the indicators we deliver are data derived from it. Its provider and the exchanges it comes from keep their rights in it, and its use is subject to their license terms.
We grant you, for as long as your access rights last, a personal, non-exclusive and non-transferable right to receive the data of the Service, display it, store it and process it for your own use, including in your own tools and strategies.
Unless we agree in writing beforehand, you may not:
- redistribute, resell, rent or make available to third parties the data received, raw or processed, in particular through an API, a stream, a file, a website or an application open to users other than you;
- share your keys or stream tokens, or let a third party connect with them;
- use the data to build a database or a service competing with Fathom Charts;
- remove the source or license notices that come with the data.
Showing, as an illustration in a publication, an occasional screenshot or chart produced from the data remains allowed, with the credit “Data: Fathom Charts”.
6. Acceptable use
You use the Service fairly and lawfully. In particular, you may not:
- get around or try to get around the limits of your plan (connections, subscriptions, rate, compute budget, export volume), authentication or access rights;
- disrupt the Service: deliberate overload, automated requests unrelated to normal use, load or penetration testing without our written consent;
- look for or exploit a security flaw. If you find one, report it to [email protected] without disclosing or exploiting it;
- decompile or extract the non-public code of the Service, except where the law allows it;
- use the Service for any unlawful activity, in particular market manipulation.
The limits of each plan are described on the Limits page. Beyond them, the API refuses the request (QUOTA_EXCEEDED, RATE_LIMITED): such a refusal is not a sanction.
7. No investment advice
The Service provides data and computations. It never places orders, manages no trading account and provides no investment advice, recommendation or personalized signal. The indicators, examples and content of the website are not an invitation to buy or sell any financial instrument.
Trading futures carries a high risk of loss, which may exceed the capital invested. You alone are responsible for your trading decisions and for the use you make of the data.
8. Availability and accuracy
We use our best efforts to keep the Service available and the data accurate and up to date. The Service is nevertheless provided without any guarantee of continuous availability or freedom from errors, in particular because it depends on third-party data:
- an outage or delay of the data provider interrupts or delays the stream, which says so (
source_delayed,source_down); - the data may contain errors, omissions or corrections from the source;
- the Service may be interrupted for maintenance, updates or security reasons; deployments are designed so that connections resume without loss through cursors;
- some historical days may be unavailable (
NOT_COVERED).
The Service evolves: we may add, change or remove features, indicators or instruments. A breaking change to the API is announced in the changelog before it goes live, except for urgent security reasons or requirements of the data source.
9. Intellectual property
The Service, its code, its computation algorithms, its documentation, and the Fathom Charts name and logo belong to us or our licensors. The Terms transfer no right in them to you, beyond the right of use set out in section 5.
The code you write to use the API, your parameters and your configurations belong to you. The code samples of the documentation may be freely copied and adapted.
If you share ideas or suggestions with us, we may use them freely, with no obligation to you.
10. Suspension and closure
You may stop using the Service at any time and ask for your account to be closed at [email protected]. Closing the account revokes its keys; a running subscription is cancelled under the terms of sale, with no refund of the current period.
In case of a breach of the Terms, a threat to the security of the Service or a requirement of the data provider, we may revoke a key or suspend an account. Except in an emergency or a serious breach (fraud, redistribution of the data, security attack), we notify you by email beforehand and give you a reasonable time to remedy the situation. In case of a serious or repeated breach, we may close the account; closure for breach gives no right to any refund.
11. Liability
We are liable for direct damage caused by a failure to meet our obligations. We are not liable for:
- trading or investment decisions made on the basis of the data, nor their outcome;
- damage resulting from use contrary to the Terms, from an exposed or shared key, or from your own infrastructure;
- interruptions and errors caused by the data provider, the exchanges, telecommunication networks or force majeure.
If you use the Service in the course of your business, our total liability, for all damage combined, is limited to the amounts you paid us during the twelve months preceding the event giving rise to it, and we are not liable for indirect damage (loss of opportunity, profit, customers or data).
Nothing in the Terms limits our liability for gross negligence or willful misconduct, for personal injury, nor the rights the law guarantees to consumers.
12. Personal data
We process your personal data as described in the privacy policy.
13. Changes to the Terms
We may change the Terms, in particular to follow changes in the Service, the law or the terms of the data provider. The current version and its date are shown on this page. A substantial change is notified to you by email at least 30 days before it takes effect; if you refuse it, you may close your account before that date. Continuing to use the Service after it takes effect means you accept it.
14. Governing law and disputes
The Terms are governed by French law. If you are a consumer living in another country, you keep the protection of the mandatory provisions of the law of your country of residence.
If a problem arises, first write to us at [email protected]: we will look for an amicable solution. Failing that, the dispute is brought before the competent courts. If you are a consumer, you may bring it before the courts of your place of residence or of our registered office. If you act in a professional capacity, exclusive jurisdiction is given to the Tribunal de commerce de Toulon.
If a clause of the Terms is held invalid, the others remain in force. Not enforcing a breach does not waive the right to enforce it later.
